Private Rental Act

Act (2012:978) on Renting Out Own Residence

What does it mean?

The Private Rental Act (2012:978) applies when an individual rents out their own home — house, cooperative apartment, or owner-occupied flat. The law gives landlords significantly more flexibility than the regular Rent Act.

The most important difference is that tenants have no tenant protection (besittningsskydd). The landlord can terminate with one month's notice without stating a reason. Rent can be set more freely but must not exceed capital costs plus operating costs.

Practical Tip

Always check whether the Private Rental Act applies. If your landlord is a private person renting out their own home, you have weaker rights. Make sure you understand the difference before signing.
