Grounds for Eviction (Disturbance)

Land Code Ch. 12, §§ 25, 42–43

What does it mean?

Störandegrund is one of the grounds that can lead to a tenant losing their tenant protection and being evicted. It involves repeated or serious disturbances affecting neighbors or the surroundings.

Examples include: repeated loud noise, threats against neighbors, illegal activity in the apartment, or serious neglect. The landlord must first issue a written warning and give the tenant a chance to improve.

Key Points

  • Repeated or serious disturbances can lead to eviction
  • Landlord must give written warning first
  • Tenant gets a chance to improve after warning
  • Social services must be notified of eviction risk
  • Serious cases (threats, crime) can lead to immediate termination

Practical Tip

As a tenant: take a disturbance warning seriously. Document that you've addressed the issue. As a landlord: document disturbances carefully with dates, witnesses, and disturbance reports.

Legal Basis: Land Code Ch. 12, §§ 25, 42–43
